This website is operated by EATbyalex AG, Giessereistrasse 14, 8005 Zürich, Switzerland (“Eat by Alex”, “we”, “us”, “our”).

By accessing our website or purchasing products from us, you agree to be bound by these Terms of Service (“Terms”). If you do not agree, please do not use our website or services.

1. Formation of Contract

Your order constitutes an offer to purchase the products listed in your cart.
A binding purchase contract is concluded only when Eat by Alex sends you an order confirmation by email.

We may refuse or cancel an order at our discretion, for example if:

  • the product is unavailable,

  • payment cannot be processed, or

  • there is evidence of misuse or reselling.

2. Prices and Taxes

All prices are stated in Swiss francs (CHF) and include VAT in accordance with Swiss law.
Shipping costs and any additional charges are shown separately before checkout.

Eat by Alex reserves the right to adjust prices at any time. Orders are invoiced at the price valid at the time of order confirmation.

3. Online Store Terms

By using this site, you confirm that you are at least 18 years old (or the age of majority in your country of residence) and legally capable of entering into binding contracts.
You may not use our products for any illegal purpose or violate any laws in your jurisdiction.
Any breach of these Terms may result in immediate termination of access.

4. General Conditions

We reserve the right to refuse service to anyone for any reason at any time.
Your content (excluding payment data) may be transferred unencrypted across networks. Payment information is always encrypted.
You agree not to reproduce, duplicate, copy, sell, resell or exploit any part of the Service without written consent.

5. Accuracy and Timeliness of Information

We endeavour to provide accurate and current information, but cannot guarantee completeness or accuracy.
All information on this site is for general guidance and not a substitute for professional medical or nutritional advice.
Eat by Alex accepts no liability for damages resulting from reliance on such information.

6. Health and Nutrition Disclaimer

Our programs, snacks and events are designed for healthy adults.
They are not suitable during pregnancy or breastfeeding, or in cases of serious digestive or metabolic disorders without prior consultation with a physician.

Eat by Alex products are produced in professional kitchens that handle ingredients such as gluten, milk, nuts, sesame, soy, celery, mustard and other allergens.
We cannot guarantee the absence of traces of any allergen.
Customers with food allergies are responsible for contacting hello@eatbyalex.com before purchase to confirm suitability.

Our products and programs are not medical treatments and do not replace advice from a doctor or dietitian.

7. Products and Services

Products and programs are available exclusively online.
Quantities may be limited and availability is not guaranteed.
We reserve the right to modify or discontinue any product at any time.

We make every effort to display product colours and images accurately, but screen variations may occur.
All descriptions and prices are subject to change without notice.

8. Shipping and Delivery

Deliveries are handled by Swiss Post (PostPac Priority).
Orders received before 14:00 (CET) on business days are dispatched the same day from our logistics partner Stiftung Ancora Meilestei, Wetzikon ZH.

Delivery within Switzerland and Liechtenstein usually takes 1–2 business days.
Once a parcel has been handed over to Swiss Post, the risk passes to the carrier.

9. Refunds and Returns

Due to the nature of our food products, returns and exchanges are not accepted.
Refunds are handled exclusively according to our Refund Policy at
www.eatbyalex.com/policies/refund-policy.

10. Accuracy of Billing and Account Information

You agree to provide current, complete and accurate purchase and account details.
We may cancel or limit orders that appear to be fraudulent, resold, or duplicated.

11. Optional Tools and Third-Party Links

We may offer access to third-party tools or links (“Third-Party Services”).
Eat by Alex is not responsible for the content, accuracy, or policies of Third-Party Services.
Use of these services is at your own risk and governed by the respective provider’s terms.

12. User Content, Reviews and Feedback

By submitting reviews, testimonials, ideas or other content, you grant Eat by Alex a non-exclusive, royalty-free, worldwide licence to use, edit and publish that content for marketing and communication purposes.
If you prefer that your testimonial not be used, notify us at hello@eatbyalex.com and we will remove it.

13. Personal Data

Your submission of personal data through the store is governed by our
Privacy Policy,
which complies with the Swiss Federal Act on Data Protection (revFADP) and the EU GDPR.

14. Errors and Omissions

We reserve the right to correct errors or inaccuracies and to update or cancel orders affected by such errors, including after submission.
We are not obliged to update all site information continuously unless required by law.

15. Prohibited Uses

You are prohibited from using this site or its content for unlawful or abusive purposes, including but not limited to fraud, harassment, discrimination, malware distribution, or infringement of intellectual-property rights.
Violation may result in termination of access and potential legal action.

16. Disclaimer of Warranties

The Service and all products are provided “as is” and “as available”, without warranties of any kind.
Eat by Alex does not guarantee uninterrupted or error-free operation.
To the fullest extent permitted by Swiss law, we disclaim all liability for indirect, incidental or consequential damages.

17. Limitation of Liability

Eat by Alex’s total liability for any claim arising from the use of our website or products is limited to the amount paid for the order in question.
Nothing in these Terms excludes liability for intent or gross negligence under Swiss law.

18. Indemnification

You agree to indemnify and hold harmless Eat by Alex, its officers, employees and partners from any claims or damages arising from your breach of these Terms or violation of applicable law.

19. Force Majeure

Eat by Alex shall not be liable for delays or non-performance caused by circumstances beyond its reasonable control, including natural disasters, war, pandemics, strikes or government actions, in accordance with Art. 97 ff. of the Swiss Code of Obligations (OR).
We will notify affected customers as soon as possible and may modify, delay or cancel deliveries as necessary.

20. Governing Law and Jurisdiction

These Terms of Service and all related agreements are governed by Swiss law, excluding its conflict-of-law provisions.
The exclusive place of jurisdiction is Zürich, Switzerland.
For consumers residing in the EU or EEA, mandatory consumer-protection rules of their home country remain applicable.

21. Changes to the Terms

Eat by Alex may modify these Terms at any time.
The latest version is always available at www.eatbyalex.com/policies/terms-of-service.
Continued use of the website after changes are posted constitutes acceptance.
